501.01: Construction, Renovation, and Alteration
All construction, renovation, and alteration projects involving campus facilities are subject to approval by the ACCS Chancellor and, for contracts over $500,000, the ACCS Board of Trustees.
In the case of an emergency, the college President must declare in writing the details of the nature of the danger to public health, safety, or convenience which would result from delay of any contemplated work. The President’s written declaration shall be immediately forwarded to the Chancellor. Only matters that are determined to be legitimate emergencies will be approved by the Chancellor. If approved, written notice will be sent to the college President and the Division of Construction Management. The college may utilize the design professional already under contract to the college at the time of the emergency to request plans and begin work to address the emergency.
If the cost of the emergency work exceeds $500,000.00 the emergency project must be submitted to the Board of Trustees for approval as soon as practical.
502.01: Leases
- The Board authorizes the Chancellor to approve leases of College/ ACCS property and eases of property from third parties having a total lease payment amount for the entire lease term of $500,000 or less. The Chancellor is also authorized to approve the renewal of leases previously approved by the Board and leases with State of Alabama agencies. The Board further authorizes the Chancellor to execute all documents necessary to effectuate the leases so approved.
- The Chancellor shall report to the Board on a monthly basis all leases so approved by providing the name of the institution, a description of the premises including its location, the term of the lease and the annual rental amount.
- All leases of College/ACCS property and leases of property from third parties having a total lease payment amount for the entire lease term in excess of $500,000 shall be submitted to the Board for approval.
- All requests for lease approval regardless of the total lease payment shall be initially submitted to the ACCS Facilities Division through a project request form for lease approval. The ACCS Facilities Division will then work with the requesting party to seek appropriate approval from the Chancellor or the Board, including, but not limited to, Legal review and approval of the Lease agreement and determining appropriate due diligence on the property in question such as whether a Phase I environmental is needed.
507.01: Temporary Use of Campus Facility
Approval for the public use of community or technical college facilities and/or grounds shall be delegated to the President. The use shall be compatible with the mission, philosophy, functions, and objectives of the institution.
510.01 Safety and Security
Enterprise State Community College is committed to providing a safe environment for students, faculty, staff and other campus visitors. To support this commitment, ESCC will adopt and continuously update an Emergency Operations Plan (EOP) and hold active drills and exercises at each campus. Safety and security training will be included in new student and employee orientation, and faculty and staff will participate in safety and security training annually. Annual safety and security reports will be completed in compliance with state and federal law.
Any student, officer, employee, or community visitor who commits any act which interferes with the normal, orderly, peaceful, or efficient conduct of activities may be directed by an official of the institution to leave the campus or facility. Failure to do so may result in trespass charges by the institution through the appropriate local law enforcement agency or court.
510.02 Parking
Parking

All students and faculty are required to register their vehicles with the College through the Business Office and Campus Security. Students and faculty will receive, and be asked to display in or on their vehicles, parking decals.

Faculty parking areas are designated as such and are restricted to vehicles with the appropriate parking decals. Violations of this policy will result in a fine.

Vehicles should not be left on campus overnight without prior notification to Campus Security.
Parking Fines
-
Enterprise State Community College provides parking areas for students, faculty and staff, and visitors. Parking areas are marked and these designations are to be observed by all persons parking a vehicle on any ESCC campus.

Tickets, carrying with them fines of $15.00, may be issued to persons violating parking, traffic, or other campus safety rules. Fines must be paid in the Business Office and become due and payable five (5) school days from the date of issuance.

All fines and tickets may be appealed by contacting the Campus Police Office within five (5) school days from the date of issuance. If no appeal is made within this time period, the right of appeal is waived and all fines are due and payable.

Fines not paid within the designated five (5) day period may result in penalties including, but not limited to, withholding of transcripts or denial of future enrollment.

510.03: Loitering
Any camping, sleeping or overnight stays on college-owned or controlled property, not previously authorized, is prohibited. Loitering on college-owned or controlled property including buildings and parking lots is prohibited.
Loitering on college premises is defined as:
- Lingering idly or aimlessly in any area of the campus without official business; or
- Hanging around in clusters and creating or causing unusually loud and disturbing noises and/or wandering aimlessly about campus; or
- Remains or wanders about college-owned or controlled property for the purpose of begging; or
- Being masked, loiters, remains or congregates on college-owned or controlled property. A person does not commit this violation if he is participating in a public presentation of an educational, religious, or historical character, play or in an in event; or
- Loiters or remains in or about college-owned or controlled property after having been told to leave by any authorized official of Enterprise State Community College, and not having any reason or relationship involving custody of or responsibility for student or any other specific, legitimate reason for being there.
Anyone identified loitering on any college-owned or controlled property may be cited for violating the campus loitering policy, asked to leave or arrested. And, if currently attending ESCC, may also be subject to campus disciplinary action.
510.04: Abandoned Vehicle Policy
Enterprise State Community College/Alabama Aviation College campuses or other instructional sites does not allow for the overnight parking of vehicles on campus unless prior permission is granted by the office of the campus police. Vehicles left on campus for period of 48 consecutive hours or more will be considered abandoned unless prior approval was given by the campus police for overnight parking.

Right to Tow Vehicles
The college reserves the right to tow vehicles from Enterprise State Community College property at any time, with or without prior notice, and at the owner's expense. Violations where towing may result are, but not limited to:
- Blocking service or emergency lanes.
- Unattended vehicles impeding the function of college parking lots.
- Unattended vehicles obstructing vehicular traffic.
- All abandoned or disabled vehicles that remain on the premises in excess of (48) forty-eight consecutive hours unless otherwise permitted by the Chief of Safety and Security.
The vehicle will be inventoried and towed to the city rotational vehicle storage facility for further disposition. All towing charges incurred will be the responsibility of the owner/driver.
510.05: Hoverboard Skateboard Policy
Due to safety concerns associated with hoverboards including falls, spontaneous combustion, and other factors raised by the Consumer Product Safety Commission (CPSC), Enterprise State Community College has decided to institute a ban on these devices. Further, the use or possession of skateboards, longboards, roller-blades, skates, razor scooters, self-balancing scooters, battery-operated scooters, hands-free segways, and etc. are prohibited on al Enterprise State Community College/Alabama Aviation College campuses or instructional sites.
Exceptions
Possession is defined as being in the immediate area or room with an item. As such, the items mentioned in this policy may be stored in vehicle parked ESCC property while the owner is on campus.
510.06: Lost and Found Property
Lost and Found property is maintained by the Chief of Safety and Security. Found property is inventoried and held in the Campus Police vault for 90 days*. All reasonable attempts are made to locate the owners of property turned into Lost and Found. Property not claimed within 90 days is disposed of or donated to charitable causes.
*Perishable items, items of no apparent value, or low-value personal items that would present hygiene issues if used by other than the owner (such as lip balm, hair clips, etc.), will be discarded.
511.01: Firearms on Campus
Enterprise State Community College and the Alabama Aviation College seeks to maintain a safe and welcoming environment for all students, faculty, staff, and visitors. Except as authorized in this policy, the College prohibits the possession, transportation, and use of firearms and any other dangerous weapons on any college campus.
Firearms are prohibited on campus or on any other facility operated by the institution. Exceptions to this policy are:
- Law enforcement officers legally authorized to carry such weapons who are officially enrolled in classes or are acting in the performance of their duties or an instructional program in which firearms are required equipment.
- Individuals not otherwise prohibited from possession of a firearm by state or federal law may possess a firearm and ammunition for that firearm in the individual's privately owned motor vehicle while parked or operated on the grounds of the institution; provided, that the individual satisfies all of the following conditions:
- If the firearm is a pistol, the individual is not generally prohibited from possession of a pistol by state or federal law.
- If the firearm is any firearm legal for use for hunting in Alabama other than a pistol:
- The individual possesses a valid Alabama hunting license.
- The firearm is unloaded at all times while on the grounds of the institution.
- It is during a season in which hunting is permitted by Alabama law or regulation.
- The individual has never been convicted of any crime of violence.
- The individual has no documented prior incidents on the grounds of the institution involving the threat of physical injury or which resulted in physical injury to another.
- The motor vehicle is operated or parked in a location where it is otherwise permitted to be.
- The firearm is either of the following:
- In a motor vehicle attended by the individual and kept from ordinary observation within the individual's motor vehicle.
- In a motor vehicle unattended by the individual, kept from ordinary observation and locked within a compartment, container, or in the interior of the individual's privately owned motor vehicle or in a compartment or container securely affixed to the motor vehicle.
If the institution believes that an individual presents a risk of harm to himself, herself, or to others, the institution may inquire as to whether the individual possesses a firearm in his or her private motor vehicle. If the individual does possess a firearm in his or her private motor vehicle on the property of the institution, the institution may make any inquiry necessary to establish that the individual is in compliance with section (2) above. If the individual is not in compliance with section (2), the institution may take adverse action against the individual, in the discretion of the institution.
514.01 Use of Tobacco Products
It is the policy of Enterprise State Community College that no student or College official use any tobacco products while engaged in any official College class, game, performance, practice, or activity, whether on or off the campus. Violation of this policy may result in disciplinary action.
For the purposes of this policy, a tobacco product is defined to include any lighted or unlighted cigarette, cigar, pipe, bidi, clove cigarette, electronic cigarette, vapor-type smoking device, and any other smoking product, as well as smokeless or spit tobacco, also known as dip, chew, snuff, or snus, in any form.
NOTE: There is no smoking allowed within 30 feet of campus buildings. If the campus has a designated smoking area, then students may only use that area.
Consequences
The first violation will result in a citation, and a fine may be assessed.
The second violation will result in a citation, and a fine may be assessed.
The third violation, at the discretion of the Dean of Students or his designee, will result in the student being sent to the College disciplinary committee and the procedures for that committee will be followed.
Appeals
Individuals shall have their appeals processed within thirty (30) days of the date of the citation. The time for appealing a fine is Monday-Thursday 7:30 a.m. - 4:30 p.m. or Friday 7:30 a.m. - 2:00 p.m. All appeals are reviewed by the Dean of Students. All appeal decisions shall be submitted to the individual in writing.
Fines
All fines are $15. All fines are to be paid at the campus site, center, or facility Business Office. Failure to pay fines may result in transcripts being withheld and further enrollment denied.
515.01: Agents, Vendors, and Solicitors
An agent, vendor, or solicitor shall not be permitted on campus to distribute literature, solicit funds, or sell to faculty, staff, students, or campus organizations without specific approval by the President or an authorized designee.
516.01: Use of College Name or Logo
Enterprise State Community College does not permit the use of its name or logo in any announcement, advertisement, publication, or report if such use in any way implies college endorsement of any person, product, or service.
Any firm or its advertising agency requesting the use of pictures or facilities of the college for sale or advertising purposes, or requesting the use of any copy relating to such pictures or facilities, should be referred to the President. The President is responsible for determining whether the college's name or logo may be used in conjunction with the particular project or service.
517.01: Animals and Pets on Campus
No animal or pet may be brought on campus. Exceptions to this policy include guide dogs for the disabled, laboratory animals, animals to be used for previously-approved instructional or special programs, and pets placed in designated pet shelters only when the Governor declares the use of the campus as a hurricane evacuation shelter. Policy 517.02 Service Animal Policy clarifies the designation and reporting of service animals.
517.02: Service Animal Policy
The following policy is designed to provide guidance regarding the use of service animals by enrolled students with disabilities on the campus of Enterprise State Community College (ESCC), and the Alabama Aviation College (AAC).
Students are highly encouraged to register their service animal with the ADA Office in the BWC/Snuggs Hall at the Enterprise Campus with ADA Coordinator, Dava Foster by submitting a Service Animal Registration Form and documentation of current vaccinations. Although a student is not required to register a service animal, it is highly encouraged for the safety of students and the service animal.
ADA regulations require that service animals be individually trained to do work or perform tasks for a person with a disability. The work or task must be directly related to the handler’s disability. ESCC cannot ask about the nature of a person’s disability, require medical documentation, or require a special identification card or training documentation for the service animal. The ADA regulations define a service animal to be a canine or a miniature horse. Guard dogs or emotional support animals are not included as part of the ADA’s definition of a service animal. Pets that do not provide a service to a person with a disability are not permitted.
Responsibilities of Students Using Service Animals
ESCC and AAC permits service animals, which are individually trained to provide assistance to an individual with a disability, on campus and in its public facilities, subject to the following conditions:
- The service animal has the appropriate and current vaccinations. For example, dogs would require proof of current rabies vaccination and/or rabies tags.
- Students/handlers will ensure the good conduct, health, care, and protection of their service animal. For example, cleanliness of the service dog is essential with adequate preventative measures taken.
- The service animal should be house-broken (i.e. trained so that absent illness or accident, the animal controls its waste elimination).
- The service animal should be kept under control at all times and on a leash, tether, or harness in public areas (except where these devices interfere with the service animal’s task or the individual’s disability prevents using these devices, the service animal must still be under control through voice control, signals, or other effective means).
- Student/handler is responsible for any damage done by the animal and for the upkeep and cleanliness of any area traversed or occupied by the animal.
- The student/handler is responsible for the immediate removal and proper disposal of all fecal matter and other waste of the service animal.
- It is the student handler’s responsibility to update all service animal documentation records on an annual basis, for example rabies vaccination records and/or other appropriate and current vaccinations. The College has the authority to remove a service animal when the student/handler or service animal fails to meet the conditions of this document. A service animal may be excluded from the campus if the animal is disruptive or poses a direct threat to the health and/or safety of others. The College and its employees shall be held harmless in the event that the animal damages property or causes harm to anyone on campus.
Service animals may be required to wear protective gear or be denied access to sterile surgical rooms, areas with hazardous machinery, research laboratories containing chemicals or biological substances that could potentially harm a service animal, on a case-by-case basis.
It is the student/handler’s responsibility to inform others that the animal is a service animal and should not be petted, bothered, harassed, or fed. The use of a collar or harness that identifies the animal as a service animal is strongly recommended to communicate the animal’s status.
Requirements for Faculty, Staff and Students
Members of the ESCC/AAC community are responsible for the following:
- Allowing service animals to accompany the person with the disability in all areas of campus where the public is normally allowed, including attendance at a campus sponsored event or activity.
- Allowing service animals in public areas even if state or local health codes prohibit animals on the premises.
- Not separating or attempting to separate a student/handler from his/her service animal.
- Not distracting the service animal in any way. For example, do not feed, pet, startle, or interact with the service animal without the student’s/handler’s permission.
- Clarifying an animal’s status as a service animal should be directed to the ADA Coordinator, Dava Leverette at 334-247-2623 ext. 2293 or emailing dleverette@escc.edu when it is not readily apparent what service an animal provides.
Conflicting Disabilities
If another person on campus has a covered disability under the ADA and that person is impacted by the presence of a service animal, a request for assistance should be made to the ADA Coordinator. All facts surrounding the contact will be reviewed and an effort to resolve the disability related needs/accommodations of all persons involved will be made. If others complain about the service animal and there has been no violation or incident, the student/handler should explain that the service animal is necessary, and that federal law protects the right of the person to be accompanied by the trained service animal in public places under most circumstances.
The College follows all applicable laws and regulations to protect the health and safety of the campus community and those animals which it permits on campus. Any individual who believes that he/she is being denied access to buildings, transportation, or programs should immediately inform the ADA Coordinator at 334-3472623 ext. 2293 or email dleverette@escc.edu.
Anyone in violation of this policy may be subject to disciplinary action.
Registering a Service Animal with the Center for Disability Services
The service animal handler/student is encouraged to register the service animal with the ADA Office and ADA Coordinator by submitting the following forms:
- Student Service Animal Registration Form
- Documentation of current vaccinations as required by law

519.01: Naming of Buildings and Other College Facilities
The College must receive prior approval from the Chancellor and ACCS Board of Trustees to name any of its facilities to memorialize or honor individuals.
520.01: Purchase, Sale or Acceptance of Real Property
1. College Presidents, working with the ACCS Chancellor and System Office, may enter into agreements to purchase real property, sell real property, or accept real property as a gift. Any such agreement shall clearly state that the agreement is subject to the approval of the ACCS Board of Trustees.
2. Action Items authorizing the purchase of real property by the ACCS shall contain, at a minimum, the following information:
- Narrative explaining why the purchase of the subject property is needed or why the purchase is in the best interest of the ACCS
- Legal Description of the subject property
- Phase I Environmental Assessment
- One Appraisal of the subject property. If the property has an estimated value in excess of $250,000 the Board of Trustees Facilities Committee shall determine the number of appraisals required for property
- Total Cost to Purchase the subject property
- Funding Source(s) to pay for the Purchase
- Estimated Cost to pay for improvements (Hazmat removal, renovations, etc.) that will be required for the ACCS to use the property for its intended purpose
- Any other items requested by the Board of Trustees or any Board of Trustees Committee
3. Action Items authorizing the sale of ACCS real property shall contain, at a minimum, the following information:
- Narrative explaining why the sale of the subject property is in the best interest of the ACCS
- Legal Description of the subject property
- One Appraisal of the subject property. If the property has an estimated value in excess of $250,000 the Board of Trustees Facilities Committee shall determine the number of appraisals required for property.
- Proceeds to the ACCS from the sale of the subject property
- Any other items requested by the Board of Trustees or any Board of Trustees Committee
4. Action Items authorizing the acceptance of real property as a gift by the ACCS shall contain, at a minimum, the following information:
- Narrative explaining why the acquisition of the subject property is needed or why the acquisition is in the best interest of the ACCS
- Legal Description of the subject property
- Phase I Environmental Assessment
- Estimated Cost to pay for improvements (Hazmat removal, renovations, etc.) that will be required for the ACCS to use the property for its intended purpose
- Any other items requested by the Board of Trustees or any Board of Trustees Committee
